Fully Tuff Terms of Service

1. Agreement to these terms
By downloading or using Fully Tuff (the "app", "Service", "we", "us", "our"), you agree to these Terms of Service. If you don't agree, don't use the app.
These terms apply to the Fully Tuff app on iPhone and Apple Watch, the website at fullytuff.com, and everyone who uses either. Our Privacy Policy explains what happens to your information and is part of these terms.
2. What Fully Tuff is
Fully Tuff is a workout logging and training app. You can record workouts in plain language, by voice, or from a photo; track your training history, programs and progress photos; record workouts on Apple Watch; and, if you turn on AI features, get suggestions, plans, program changes and feedback from an AI Coach based on what you logged and, if you allow it, data from Apple Health.
Fully Tuff is a fitness and training tool. It is not a medical device, a medical records system, an emergency service, or a substitute for professional medical, physical therapy, or nutrition advice. Don't enter medical records, government identifiers, payment card numbers, passwords, or anything else not needed to track your training.
We may change, suspend, or discontinue any part of the app at any time.
3. Beta software
Fully Tuff is currently in beta testing, distributed through Apple's TestFlight. Beta software is a work in progress, and by using it you understand that:
- It may contain bugs, behave unexpectedly, or become temporarily unavailable.
- Features may change, be added, or be removed between builds without notice.
- Your data may not be preserved. A beta build can lose or reset workout history, notes, photos, or settings. Don't rely on Fully Tuff as the only record of anything important to you during the beta.
- We may contact you about your testing. You can leave the beta at any time by removing the app. Removing the app does not delete an account or Cloud Backup; see section 4 for that.
Your use of TestFlight is also governed by Apple's TestFlight terms. When Fully Tuff is released publicly, these terms continue to apply and the beta-specific points above no longer do.
4. Your account
You need to sign in to use Fully Tuff. You can sign in with Apple or with Google. With Apple, you can hide your email, and we receive an Apple private relay address instead of your real email address.
You are responsible for what happens under your account and for keeping your Apple or Google sign-in secure. Tell us if you think your account is being used without your permission.
You must be at least 13 to use Fully Tuff, and at least 18 to use physique feedback. We can refuse service or close accounts at our discretion.
You can delete your account at any time in Settings, under Account. This deletes what we hold on our servers for the account, as described in the Privacy Policy. Workouts on your device and in your iCloud stay until you delete them in the app.
5. Health, fitness, and AI: read this one
Exercise carries risk of injury. You're responsible for training safely and within your own limits.
Talk to a doctor before starting a new training program, especially if you have an injury, a medical condition, are pregnant, or haven't trained in a while.
The AI Coach generates suggestions from your data. It is not a doctor, physical therapist, dietitian, or certified trainer, and its suggestions can be wrong, incomplete, or unsuitable for you. Treat them as a starting point, not instructions.
Stop immediately and seek medical attention if you feel pain, dizziness, or anything wrong during exercise. Don't push through it because an app told you to.
The Coach may suggest nutrition targets, such as calories, protein or a macro split. These are general information for healthy adults, not clinical nutrition advice, and they are not suitable for anyone with an eating disorder, diabetes, kidney disease, or another condition affected by diet. See a doctor or registered dietitian for advice that fits you.
Physique feedback is AI-assisted visual feedback on photos you choose to send. It is not a medical assessment, a diagnosis, or a measurement of body fat or body composition, and it can be wrong.
The Coach can build programs and propose changes to your planned workouts. Review any plan or change before you train from it.
We make no warranty that any recommendation, plan, estimate, or feedback in the app is accurate, complete, or appropriate for you. You use the app's training and AI features at your own risk.
6. AI features and your data
AI features are off until you agree to them in the app. When you use one, such as the Coach, plan and program building, workout insights, reading workout lines or imported files, logging from a photo, photo questions, physique feedback, voice dictation, or read aloud, the app sends the information that feature needs to our AI providers. We use them through their paid APIs, under terms that do not use API data to train their models by default. What is sent, and how to control it, is described in the Privacy Policy.
If you paste a link into a Coach question, the AI provider may visit that page to answer.
AI features have usage limits, such as daily and monthly limits on Coach requests and a weekly limit on physique feedback, to keep the service running for everyone. We may change these limits.
AI outputs can be wrong. Review them before relying on them, especially anything touching injuries, medical conditions, or nutrition.
7. Your content
You keep ownership of what you put into Fully Tuff: your workouts, notes, voice recordings and photos.
You grant us a limited license to store, process, and transmit that content only to operate the app for you, including sending it to our AI providers when you use an AI feature, syncing workouts and programs to your own iCloud, and storing a Cloud Backup if you make one. We don't use your content to advertise, and we don't sell it.
You're responsible for having the right to submit anything you send, including photos. Don't send photos of other people without their permission, and don't use physique feedback with photos of anyone other than yourself.
8. Acceptable use
Don't use Fully Tuff to break the law, gain unauthorized access to the Service, interfere with other users, introduce malicious code, scrape or automate access, or get around rate limits, usage limits, authentication, or security controls. Don't use credentials or backups for an account you don't control, and don't use the AI features to generate content that is illegal or harmful.
9. Price and future subscriptions
Fully Tuff is free during the beta. If we later offer paid features, they will be sold through the App Store, and the price and terms will be shown before you buy. Payments, renewals, cancellations and refunds are handled by Apple under App Store policy, and you manage them in your Apple Account settings.
10. Intellectual property
Fully Tuff, including its name, mascot, design, code, the Coach's voice and character, and its features, belongs to us and is protected by law. Don't copy, reverse engineer, extract source, or use our name, brand, mascot, or the coaching character without written permission. This doesn't affect your ownership of your own content under section 7.
11. Third-party services
Fully Tuff relies on service providers we don't control. They include the platform you use to download, sign in, and sync, and providers that host accounts, process AI requests, deliver the website and email, and help us understand crashes and how features are used. Their handling of data is governed by their own terms and privacy policies. We're not responsible for those services. What leaves your device, and why, is described in the Privacy Policy.
12. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OR RELIABILITY OF INFORMATION. We don't warrant the app will be uninterrupted, secure, or error-free.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FULLY TUFF WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES; FOR LOSS OF PROFITS, DATA, OR GOODWILL; FOR PERSONAL INJURY ARISING FROM YOUR USE OF THE APP'S TRAINING OR AI FEATURES EXCEPT WHERE CAUSED BY OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT; OR FOR AMOUNTS EXCEEDING WHAT YOU PAID US IN THE PAST 12 MONTHS. Some jurisdictions don't allow these limits, so some may not apply to you.
14. Indemnification
You agree to hold Fully Tuff harmless from claims arising out of your use of the app, your violation of these terms, your violation of anyone's rights, or your content.
15. Termination
We may suspend or close your account for breaking these terms or for conduct that harms other users or the Service. You can delete your account any time in Settings. On termination, your right to use the app ends; your on-device data remains yours and under your control.
16. Governing law
These terms are governed by the laws of the State of Maryland and the United States, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts located in Maryland.
17. Changes
We may update these terms. We'll post the new version here, update the effective date, and, for material changes, give notice in the app or by email. Continuing to use the app after a change means you accept it.
